Acceptable Use Policy
1. Purpose
This Acceptable Use Policy ("AUP") governs what Destiny may and may not be used for. By using the Service, you agree to comply with this policy. This AUP is incorporated by reference into the Terms of Service.
Tavernix reserves the right to update this policy at any time. Continued use of the Service constitutes acceptance of the current version.
2. Permitted Uses
Destiny is designed for legitimate business communications. Permitted uses include:
- Appointment reminders and scheduling confirmations sent to existing customers.
- Customer follow-up calls and SMS after a prior business interaction.
- Support outreach to customers who have requested assistance.
- Sales prospecting to contacts who have provided prior express consent to be contacted.
- Informational campaigns such as service updates, billing notices, and product announcements to opted-in recipients.
3. Prohibited Uses
The following uses of Destiny are strictly prohibited:
- Sending spam or placing unsolicited calls or messages to contacts who have not provided prior express consent to be contacted.
- Running robocall campaigns that violate the Telephone Consumer Protection Act (TCPA) or FCC regulations.
- Contacting numbers listed on the National Do Not Call Registry without documented prior express written consent from those individuals.
- Using deceptive or misleading scripts that misrepresent the caller's identity, company, or purpose of the call.
- Delivering content that constitutes harassment, threats, intimidation, or abuse toward any individual.
- Collecting sensitive personal data — including full credit card numbers, Social Security numbers, or passwords — through IVR or automated call flows.
- Promoting illegal goods, services, or activities.
- Any use that violates applicable federal, state, or local law.
4. TCPA Compliance Responsibility
Customers are solely responsible for compliance with the Telephone Consumer Protection Act and all applicable regulations governing automated calls and text messages. This includes:
- Obtaining proper prior express written consent before contacting any individual via automated call or SMS.
- Maintaining and honoring your own internal Do Not Call lists.
- Scrubbing contact lists against the National Do Not Call Registry as required by law.
- Complying with applicable time-of-day restrictions for outbound calls and messages.
Destiny provides the technology platform only. We do not provide legal compliance advice. If you are unsure whether a campaign complies with applicable law, consult a qualified attorney before proceeding.
5. Enforcement
Tavernix monitors for patterns of misuse and investigates reports of policy violations. Violations of this AUP may result in immediate suspension or permanent termination of your account without refund. In cases of serious or repeated violations, Tavernix may also report conduct to relevant regulatory authorities.
6. Reporting Violations
If you believe someone is using Destiny in violation of this policy, please report it to [email protected]. We investigate all reports and take appropriate action.
